Why Indian Businesses Need a Compliance Calculator

Labour law compliance in India is not optional — it is a minefield of deadlines, penalties, and imprisonment clauses that catches even experienced HR teams off guard. A single late PF deposit can attract 12% annual interest plus up to 100% damages under Section 14B. Missing the ESI deadline triggers 12% interest and potential prosecution. Paying below minimum wage carries a ₹50,000 fine on the first offence and ₹1,00,000 plus imprisonment on repeat.

The problem is not intent. Most Indian employers want to comply. The problem is that compliance rules are scattered across 44 central labour laws (now being consolidated into 4 labour codes), vary by state, change frequently, and require tracking monthly deadlines that differ by obligation type. One missed date triggers a penalty that is disproportionate to the oversight.

That is exactly why we built this page. Below, you will find six free compliance calculators covering EPFO penalties, ESI contributions, minimum wage checking, absenteeism tracking, and maternity/paternity leave entitlements. We have also included five reference tables with real 2026 data — a monthly compliance calendar, EPFO penalty slabs, ESI rate card, state-wise minimum wages, and a comprehensive non-compliance penalty chart — so you can verify your compliance posture against current law.

Who is this page for?

Monthly HR Compliance Calendar — India 2026

Every compliance deadline Indian HR teams must hit each month, with penalty for missing it

Missing a single compliance deadline in India does not just trigger a fine — it starts a compounding penalty clock. PF deposits due on the 15th start attracting 12% annual interest from the 16th, with damages calculated separately. TDS deposited even one day late on the 8th incurs 1.5% per month interest from the date the tax was deducted. The table below is the monthly checklist every HR team should print, screenshot, or bookmark. For a complete penalty calculation on any missed deadline, use the EPFO Penalty Calculator.

EPFO Penalty Slabs — Section 7Q Interest + Section 14B Damages

What you actually pay when PF is deposited late · Updated with post-June 2024 rates

Late PF deposit triggers two separate penalties that compound on each other. Section 7Q charges simple interest at 12% per annum on the delayed contribution amount, calculated from the due date. Section 14B imposes damages on top of the interest — these damages were historically graduated (5% to 25% based on delay period) but were simplified to a flat 1% per month after June 2024 under Paragraph 32A of the EPF Scheme. The old graduated rates still apply to delays that occurred before July 2024. Use the EPFO Penalty Calculator to compute the exact combined cost for any delay period.

Wilful non-payment of PF: Under Section 14 of the EPF Act, wilful failure to deposit employee PF contributions carries imprisonment of 1 to 3 years and a fine up to ₹10,000 on the first offence. Repeat offences: 2 to 5 years imprisonment and ₹25,000 fine. The law treats retained employee contributions as a criminal breach of trust.

Source: EPF & MP Act 1952, Sections 7Q and 14B. Para 32A of the EPF Scheme 1952 (amended June 2024) introduced the flat 1% per month damages rate, replacing the graduated structure for new defaults. The 12% interest under Section 7Q is charged separately and in addition to Section 14B damages — they are not either/or. For an exact calculation with your amounts and dates, use the EPFO Penalty Calculator.

ESI Contribution Rates & Penalties — Quick Reference

Employee State Insurance rates, wage ceiling, and penalties for non-compliance (FY 2025-26)

ESI (Employee State Insurance) provides medical, sickness, maternity, and disability benefits to employees earning up to ₹21,000/month. The contribution is shared between employer (3.25%) and employee (0.75%), with a combined rate of 4% of gross wages. Unlike PF, ESI applicability is an all-or-nothing threshold — once gross salary exceeds ₹21,000/month, the employee exits ESI coverage entirely. Use the ESIC Calculator to check eligibility and compute contributions for any salary level.

Source: ESI Act 1948, Sections 39, 44, 85, and 85A. The wage ceiling was last revised to ₹21,000 in 2017. Employees earning above this threshold are not covered under ESI and must be provided alternative health insurance by progressive employers. ESI registration is mandatory for factories with 10+ employees and other establishments with 20+ employees in notified areas. For exact contribution calculations, use the ESIC Calculator.

State-Wise Minimum Wages in India — 2026 Rates

Monthly minimum wage rates for unskilled and skilled workers across major Indian states (as of April 2026)

India does not have a single national minimum wage. Rates are set by each state and revised periodically (some states revise annually, others every 2-3 years). The variation is massive — Delhi’s unskilled minimum wage at ₹18,066/month is nearly 75% higher than Madhya Pradesh’s at ₹10,500. Multi-state employers must track each state’s notification separately. Under the Code on Wages 2019, paying below minimum wage now carries a ₹50,000 fine on the first offence, up from ₹500 under the old Minimum Wages Act 1948. Use the Minimum Wage Checker to verify compliance for any state and skill category.

Indian Labour Law Penalties — Complete Reference Chart 2026

Every major non-compliance penalty across EPF, ESI, Wages, Maternity, and Gratuity — in one table

This is the table most HR professionals wish they had discovered before receiving a penalty notice. Indian labour law penalties are not just fines — many carry imprisonment clauses that apply to the principal employer or the person responsible for the establishment. The penalties below are the maximum prescribed by law; actual penalty in a specific case depends on the severity of the violation, the employer’s compliance history, and whether the violation was wilful. Note that the Code on Wages 2019, Code on Social Security 2020, and other new labour codes significantly increase fine amounts compared to the older acts they replace.

The new Labour Codes (when fully notified and effective in all states) will consolidate and in many cases increase these penalties. Imprisonment clauses typically apply to the principal employer, managing director, or any person responsible for the establishment. Frequently Asked Questions About HR Compliance in India

Expert answers to the compliance questions Indian HR teams, founders, and payroll consultants search for most

What happens if PF is not deposited on time?

Late PF deposit triggers two separate penalties under the EPF Act. First, Section 7Q charges simple interest at 12% per annum on the delayed amount, calculated from the date it was due (15th of the following month). Second, Section 14B imposes damages on top of this interest.

Since June 2024, Section 14B damages are a flat 1% per month on the outstanding contribution (under Paragraph 32A of the EPF Scheme). Before this change, damages were graduated: 5% for delays up to 2 months, 10% for 2-4 months, 15% for 4-6 months, and 25% for delays exceeding 6 months. The old rates still apply to defaults that occurred before July 2024.

Beyond financial penalties, wilful non-payment of employee PF contributions is a criminal offence under Section 14 — carrying 1 to 3 years imprisonment and a ₹10,000 fine for the first offence. The law treats retained employee PF contributions as a breach of trust. Use the EPFO Penalty Calculator to compute the exact penalty for any delay period.

What is the ESI wage limit in 2026?

The ESI wage ceiling is ₹21,000 per month (gross salary). Any employee whose gross wages are at or below this threshold must be enrolled under ESI, and both employer and employee contributions are mandatory. The moment an employee’s gross salary exceeds ₹21,000/month, they exit ESI coverage entirely.

This ceiling was last revised in 2017 (from ₹15,000 to ₹21,000). It covers all components of gross wages — basic, DA, HRA, and other allowances — but excludes employer PF contribution. The contribution rates are: employer 3.25% and employee 0.75%, for a combined 4% of gross wages. For a ₹21,000 gross salary, this means ₹683/month from the employer and ₹158/month from the employee.

Non-registration when mandatory carries a ₹5,000 fine, and non-payment of ESI contributions can lead to prosecution under Section 85 with imprisonment up to 2 years. Use the ESIC Calculator to check eligibility and compute contributions.

What is the minimum wage in India in 2026?

India does not have a single national minimum wage. Minimum wages are set by each state government and vary significantly based on state, industry, skill level, and zone. As of April 2026, Delhi has the highest minimum wage at ₹18,066/month for unskilled workers and ₹21,215/month for skilled workers. Central government employees have a floor rate of ₹20,358/month (unskilled).

At the lower end, states like West Bengal (₹10,400 unskilled), Madhya Pradesh (₹10,500), and Rajasthan (₹10,668) have significantly lower rates. This means a multi-state employer paying a uniform ₹12,000/month salary could be compliant in UP but in violation in Delhi.

Under the Code on Wages 2019, the penalty for paying below minimum wage has increased dramatically: ₹50,000 fine for the first offence, and ₹1,00,000 plus 3 months imprisonment for repeat offences. The Controlling Authority can also order compensation of up to 10 times the underpaid amount. Use the Minimum Wage Checker to verify compliance for any state.

When is PF due each month and when does the penalty start?

PF contributions (both employer and employee shares) must be deposited with EPFO by the 15th of the following month. For example, PF for October 2026 salaries is due by November 15, 2026. The deposit is made through the ECR (Electronic Challan cum Return) on the EPFO Unified Portal.

Interest under Section 7Q starts from the 16th — there is no grace period. Even a one-day delay triggers the 12% per annum interest calculation. Section 14B damages are calculated separately, starting from the due date.

In practice, most companies process PF deposits between the 7th and 12th of the following month to leave a buffer for ECR filing issues and bank processing time. EPFO also requires an International Workers return by the 15th for foreign employees covered under Social Security Agreements.

How many days of maternity leave are mandatory in India?

Under the Maternity Benefit Act 2017 (amended), the maternity leave entitlements are:

First and second child: 26 weeks of paid leave (increased from 12 weeks by the 2017 amendment). Of this, up to 8 weeks can be taken before the expected delivery date.

Third child onwards: 12 weeks of paid leave.

Adoption (child below 3 months): 12 weeks from the date of adoption. Commissioning mother (surrogacy): 12 weeks from the date the child is handed over.

Additionally, the Act mandates a crèche (childcare) facility in every establishment with 50 or more employees, and allows the mother four crèche visits per day. Employers who deny maternity leave face imprisonment up to 3 months and/or a ₹5,000 fine. Use the Maternity Leave Calculator to calculate exact dates and salary entitlement.

Is paternity leave mandatory in India?

Paternity leave is not mandated by any central labour law for private sector employees in India. There is no equivalent of the Maternity Benefit Act for fathers. However, Central Government employees are entitled to 15 days of paternity leave under the Central Civil Services (Leave) Rules.

In practice, most large private companies offer 5 to 15 days of paternity leave as part of their HR policy, and some progressive employers (particularly in tech and MNCs) offer 2 to 4 weeks. A few state governments have introduced paternity leave provisions for state government employees.

While not legally required, offering paternity leave has become a talent retention tool — companies advertising paternity leave policies see measurably higher scores on employer review platforms. Use the Paternity Leave Calculator to benchmark your policy and calculate the salary impact.

What is a good absenteeism rate for Indian companies?

The average absenteeism rate in Indian organisations is between 3% and 6%, depending on the industry. Manufacturing and blue-collar sectors tend to have higher rates (5-8%), while IT and services companies typically see lower rates (2-4%).

Calculating absenteeism: (Total absent days ÷ Total available workdays) × 100. For a company with 100 employees and 22 working days per month, a 4% absenteeism rate means 88 absent employee-days per month.

From a compliance perspective, Indian labour law requires employers to maintain attendance registers for all employees. Failure to maintain these records carries a ₹50,000 fine under the Code on Wages. Beyond compliance, absenteeism directly impacts productivity and costs — the average cost of absenteeism in India is estimated at 1-3% of total payroll cost. Use the Absenteeism Rate Calculator to compute your rate and see the cost impact.

What are the 4 new Labour Codes in India and are they in effect?

India’s 44 existing central labour laws are being consolidated into 4 Labour Codes:

1. Code on Wages, 2019 — consolidates the Payment of Wages Act, Minimum Wages Act, Payment of Bonus Act, and Equal Remuneration Act. This is the only code that has been partially notified.

2. Code on Social Security, 2020 — consolidates EPF, ESI, Gratuity, Maternity Benefit, and 5 other acts into a single social security framework. Introduces concepts like universal social security and gig worker coverage.

3. Industrial Relations Code, 2020 — consolidates the Industrial Disputes Act, Trade Unions Act, and Industrial Employment (Standing Orders) Act. Raises the threshold for government permission to lay off/retrench from 100 to 300 workers.

4. Occupational Safety, Health and Working Conditions Code, 2020 — consolidates 13 acts related to factory safety, mine safety, contract labour, and inter-state migrant workers.

As of mid-2026, full implementation is still pending as states need to notify their rules under each code. The existing acts continue to apply until the corresponding code and state rules are notified. HR teams should prepare for the transition but comply with current law until formal notification.

Can an employer go to jail for non-compliance with PF or ESI?

Yes. Indian labour law includes criminal liability for certain compliance violations, and the person held responsible is typically the principal employer, managing director, or the person designated as responsible for the establishment:

EPF Act (Section 14): Wilful non-payment of employee PF contributions — 1 to 3 years imprisonment + ₹10,000 fine. Repeat offence: 2 to 5 years + ₹25,000.

ESI Act (Section 85): Wilful non-payment of ESI contributions — up to 2 years imprisonment + ₹5,000 fine.

Gratuity Act (Section 9): Avoiding or refusing gratuity payment — minimum 6 months imprisonment, extendable to 2 years.

These are not theoretical penalties. EPFO and ESIC regularly initiate criminal proceedings against defaulting employers, particularly in cases involving retained employee contributions (where the employer deducted PF/ESI from salary but did not deposit it with the authority). The best protection is timely compliance and using tools like the EPFO Penalty Calculator to settle any outstanding dues immediately.

How do I calculate Professional Tax in India?

Professional Tax (PT) is a state-level tax on employment, capped at ₹2,500 per year by the Constitution (Article 276). Not all states levy it — states like Rajasthan, Delhi, and Uttarakhand do not charge PT.

The slab structure varies by state. For example, Maharashtra charges ₹2,500/year (₹200/month for 11 months + ₹300 in February) for employees earning above ₹10,000/month. Karnataka charges monthly based on gross salary slabs, with the maximum being ₹200/month. Tamil Nadu charges a half-yearly amount based on salary slabs.

The employer is responsible for deducting PT from the employee’s salary and depositing it with the state tax authority by the due date (which varies by state — see the compliance calendar above). Late payment attracts interest of 1% to 1.5% per month depending on the state. PT is deductible under Section 16 of the Income Tax Act, reducing the employee’s taxable income.
